Please read the terms below, then tick and sign.
1. Who these terms apply to
These terms apply when you book any workshop, trial session, class or programme with Growing Minds ([registered business name and SSM number]), referred to as “we” or “us”.
By signing, you confirm that you are the parent or legal guardian of the child named in the form, and that you are able to agree to these terms on their behalf.
2. Booking and payment
A place is confirmed once payment is received. Prices are those shown on our website at the time of booking.
All fees are non-refundable. This includes trial sessions, workshops, holiday programmes, and weekend club and School Readiness fees, whether or not your child attends.
If you tell us in advance that you cannot attend, we may, at our discretion, offer a make-up session, credit or transfer. This is not guaranteed.
If we have told you a trial fee will be credited to your first month, we will apply the credit when you join.
3. If we cancel or change a session
If we cancel an event or session, we will offer you a place on another date or refund the fee for that session.
We may change a venue, time or facilitator where necessary, and will tell you as soon as we can.
4. Information, health and safety
You confirm that the information you give us is accurate and complete, including any allergies and any medical, developmental or behavioural information that may affect your child's safety or participation. You will tell us promptly if anything changes.
Our activities can involve paint, water, foam, food items, art and craft materials and other substances. We take reasonable care, but we cannot guarantee an allergen-free environment.
If your child needs continuous one-to-one support to take part safely, please tell us when you book so that we can talk it through before the session.
5. Emergencies
If your child is injured or becomes unwell, we will first try to contact you. If we cannot reach you and it is urgent, you authorise us to arrange emergency medical care for your child. You are responsible for any medical costs.
6. Drop-off, collection and supervision
Unless an event says that parents stay, sessions are drop-off. You must be contactable by phone for the whole session and collect your child on time. Only you, or a person you have told us about in advance, may collect your child.
7. Behaviour
If a child's behaviour puts their own or others' safety or enjoyment at risk, we may ask you to collect them and may end their participation. Fees are not refunded in that case.
8. Clothing and belongings
Please dress your child in clothes that can get messy. We are not responsible for lost, damaged or stained belongings.
9. Risk and liability
You understand that active, messy and group play carries ordinary risks such as minor bumps, scratches and stains.
To the fullest extent permitted by law, Growing Minds is not liable for loss, injury or damage that does not result from our negligence. Nothing in these terms limits any liability that cannot be excluded by law.
10. What our sessions are
Workshops, trial sessions and classes are educational programmes. They are not a diagnosis, an assessment, or medical or therapeutic treatment, and a trial session does not replace an assessment.
11. Photos and videos
We will only use photos or videos that show your child on our website or social media if you tick the optional consent box on the booking form. You can withdraw that consent at any time by messaging us, and we will stop using the image in future materials.
12. Your personal data (Privacy Notice)
We collect the details you give in the booking form: your name and phone number; your child's name, date of birth and gender; your child's allergies, health information and other important notes; and your signature.
We use them to manage your booking, keep your child safe, contact you, and keep records. Health information is sensitive personal data. We use it only with your explicit consent, which you give by ticking the consent box on the form.
We share information only with our staff and facilitators, and with service providers that help us run bookings and payments. We may share it with medical or emergency services in an emergency, or with authorities where the law requires.
We keep it only as long as needed for these purposes and to meet legal requirements, and we store it securely.
You may ask to see, correct or delete your information, or withdraw your consent, by messaging us on WhatsApp or emailing hallo.growingminds@gmail.com. This notice is given under Malaysia's Personal Data Protection Act 2010.
13. Changes and governing law
We may update these terms. The version you signed applies to your booking. These terms are governed by the laws of Malaysia.
